Content standards:

Moreover, you agree not to access or use the Site for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Site.

(i) victimises, harasses, degrades, or intimidates an individual or group of individuals on the basis of any of the following (without limitation): religion, gender, sexual orientation, race, colour, ethnicity, national origin, citizenship, age, marital status or disability;
(ii) infringes any patent, trademark, trade secret, copyright, right of publicity or other intellectual property or proprietary right (IPR) of any party; or
(iii) you do not have a right to transmit due to a legal or contractual obligation;
d) knowingly upload, post, e-mail, or otherwise transmit any material that contains software viruses or any other computer code, files, worms, time bombs or programs designed or intended to interrupt, disable, damage, destroy, or limit the functionality of the Site or any computer software or hardware or telecommunications equipment or any other similarly destructive activity;
e) obtain unauthorised access to any system, data, password or other information;
f) interfere with or disrupt the Site or servers or networks linked to the Site, or disobey any requirements, procedures, policies, or regulations of networks linked to the Site;
g) intentionally or unintentionally violate any applicable national, or international law and any rules, regulations, orders or directives in place from time to time;
h) knowingly upload, post, e-mail, or otherwise transmit any material, or take any other actions with respect to your use of the Site, that would constitute, or would otherwise encourage, criminal conduct or conduct that could give rise to civil liability;
i) carry out commercial activities, including, without limitation, submitting any material to solicit funds or to promote, advertise or solicit the sale of any goods or services;
j) solicit others to join or become members of any other commercial online service or other online or offline group or organisation;
k) impersonate any other person or entity, including by providing any false personal information to Us (including a false username) or creating any account for anyone other than yourself;
l) submit any person’s identification documents or sensitive financial information; or
m) breach the Privacy Policy.
Violation of any of the foregoing may result in immediate termination of your Account and right to access or use the Site.
We reserve the right, but shall have no obligation, to investigate your use of the Site in order to determine whether a violation of these Terms has occurred or to comply with a legal obligation.
Our right to use User Content:
You represent and warrant that:
a) you own or otherwise control any and all rights in and to the User Content that you submit to the Site; and
b) that Our public posting and use of that User Content will not infringe or violate the rights of any third party in any manner, including without limitation any privacy rights, publicity rights, copyrights, contract rights or any other intellectual property or proprietary rights.
By submitting, sending, posting, uploading, modifying or otherwise providing information, material, or any other communication to Us including User Content, whether solicited or unsolicited, you grant to Us, Our affiliates and other users of the Site a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable and fully paid up licence to use, reproduce distribute, prepare derivative works of, display, and perform that User Content in connection with the service provided by the Site and across different media (including to promote the Site or the services available via it).
We and Our affiliates may use or otherwise transfer, remove or dispose of any and all User Content without restriction and users of the Site shall not be entitled to any compensation whatsoever for any such use, transfer or disposition of User Content by Us. Notwithstanding the foregoing, personally identifiable data, if any, included in User Content shall be handled in accordance with Our Privacy Policy.
TRANSMISSION OF MATERIALS VIA THE INTERNET AND YOUR MISUSE OF THE SITE
You understand that the technical processing and transmission of the Site may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. We assume no responsibility for the deletion or failure to store postings or other information submitted by you or other users of the Site.
We do not guarantee that the Site will be secure or free from bugs or viruses.

You may not:
a) take any action that imposes or may impose (as determined by Us in Our sole discretion) an unreasonable or disproportionately large load on Our infrastructure;

c) bypass any measures We may use to prevent or restrict access to the Site or portions thereof (or other accounts, computer systems or networks connected to the Site);
d) run any form of auto-responder or “spam” on the Site;

f) harvest or scrape any content from the Site.
These provisions should be treated as an express reservation of Our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).
The above provisions shall not apply insofar as (but only to the extent that) We are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to Us.
INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property in the Site, the material published on it and the services provided via it and all rights to such intellectual property. Those works are protected by copyright laws and treaties around the world. All such rights are reserved to Us.
You may print off one copy, and may download extracts, of any page(s) from the Site for your personal use and you may draw the attention of others within your organisation to content posted on the Site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded from the Site in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

TERMINATION
We may terminate or suspend your access to the Site, delete your profile and Account and any of your User Content and/or prohibit you from using or accessing the Site (or any portion, aspect or feature of the Site) if you are in breach of these Terms.

In the event of termination, you will still be bound by your obligations under these Terms.
OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
Nothing in these Terms excludes or limits Our liability for death or personal injury arising from Our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited by English law.
Different limitations and exclusions of liability will apply to liability arising as a result of Our supply of any products to you, which will be set out in Our Supply Terms.
To the extent permitted by law, We exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
• use of, or inability to use, the Site; or
• use of or reliance on any content displayed on the Site.
Please note that We only provide the Site for domestic and private use. You agree not to use the Site for any commercial or business purposes, and We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

If any provision of these Terms is found to be illegal or unenforceable, the remainder of the Terms shall be unaffected and shall continue to be fully valid, binding, and enforceable.
The failure of either party to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder.
No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and neither party has any authority of any kind to bind the other in any respect.
We may transfer Our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and We will ensure that the transfer will not affect your rights under these Terms.
These Terms, their subject matter and their formation (including any non-contractual disputes or claims) are governed by English Law. We both agree to submit to the exclusive jurisdiction of the courts of England and Wales.

“HydroPeptide” is a UK registered trade mark of HydroPeptide LLC (a group company of HydroPeptide Limited). You are not permitted to use this without Our prior written approval.
